This bail application has been filed on behalf of the applicant– Shabana Khatoon with prayer to release on bail in connection with Senha P.S. Case No.112 of 2020 registered under Sections 302/34 and 328/34 of the Indian Penal Code pending in the court of learned Sessions Judge, Lohardaga. Learned counsel for the applicant has submitted that the F.I.R. of this case lodged by the father of the deceased with the allegations that his daughter was murdered by administering poison by her husband in conspiracy with his second wife (the applicant herein). It is further alleged that the relations between the informant’s daughter and his son-in-law were strained and a complaint was also filed before the family court, in which the Court had directed the husband of his daughter to keep her with him. Accordingly, his daughter was sent to in-laws house, wherein she was murdered by her husband in conspiracy with the applicant. It is also submitted that there is no evidence against the applicant in regard to being party to the alleged conspiracy. Admittedly, the applicant is the second wife of the main accused Firoz Ansari, who is the husband of the deceased, who has already been granted bail by a co-ordinate Bench of this Court vide order dated 28.10.2021 passed in B.A. No.9249 of 2021. The applicant has been languishing in jail since 15.12.2020.
