04/16.08.2022: Heard both the counsels.
The learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence as alleged in the FIR. The learned counsel has further submitted that the petitioner has falsely been implicated in this case and that he is not named in the FIR and has got no concern with any banned extremists' organization. The learned counsel has further submitted that the petitioner was not present at the place of occurrence. Moreover, the petitioner is in custody since 12.04.2022. Therefore, petitioner may be released on bail.
Learned APP, appearing on behalf of the State, has vehemently opposed the bail application of the petitioner and has submitted that the petitioner belongs to extremists' organization and has at least one criminal antecedent of similar nature.
Having gone through the records of the case and the arguments advanced by the learned counsel for both the sides, present petitioner, named above, is ordered to be released on bail on executing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ranchi in connection with Chanho P.S. Case No. 154 of 2021, subject to the condition that the petitioner shall remain present on each and every date of trial before the learned Court below unless dispensed with by the learned Court below.
Let a copy of this order be delivered to the concerned Superintendent of Police of the district.
