When the matter is called out, Mr. Nawin Kumar, the learned counsel appears for the petitioner and Mr. P.K.Appu, the learned APP appears for the State.
Learned counsel for the petitioner submits that allegation against the petitioner is totally false. He further submits that the petitioner is a young man of about 21 years of age and is a student. He further submits that the alleged victim is a married lady and the petitioner would not dare to make any relationship with that lady. During course of investigation several independent witnesses have been examined but no substantial support for the prosecution case has been made by these independent witnesses. He further submits that neither any clothes of the victim was recovered nor any injury was found on the private part of the informant/victim. The petitioner is in custody since 7.4.2022, therefore, he may be released on bail.
The learned counsel for the State opposed the prayer for bail and submitted that it has come in the case diary that the clothes of the victim were torn which indicates that there was attempt to molest the victim girl. Therefore, petitioner does not deserve bail.
Having heard both counsels, gone through the records of the case and in the facts and circumstances of the case, I am inclined to release the petitioner, named above, on bail, on furnishing bail bond of Rs. 20,000/(rupees twenty thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribag, in connection with Hazaribag Muffasil PS Case No. 89 of 2022, with condition that petitioner shall attend the trial regularly.
