Heard learned counsel for the parties.

The petitioner has been made an accused in connection with S.T. No. 57 of 2019 arising out of Murhu P.S. Case No. 74 of 2015 corresponding to G.R. No. 500 of 2015 (S), registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of Arms Act and Section 17 of CLA Act, pending in the court of learned District & Additional Sessions Judge I, Khunti.

As per F.I.R. allegation is that husband of the informant, who was an evangelist, was shot at by unknown miscreants, which resulted in his death.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence at all as alleged in the F.I.R rather his name has surfaced on the basis of confessional statement of coaccused, namely Rajen Dhanga. It is further submitted that nothing incriminating article has been recovered from the possession of the petitioner. The petitioner is languishing in Judicial custody since

26.02.2018 without rhymes and reasons. It is also submitted that other coaccused, namely, Surju Mundu and Kaila Horo have been granted bail by the Co-ordinate Bench of this Court in B.A. Nos. 5774 of 2020 and 11459 of 2021 vide order dated 01.02.2021 and 18.11.2021 respectively. It is also submitted that there is no chance of absconding or tampering with the prosecution evidence, hence, the petitioner may be enlarged on bail.

Learned A.P.P appearing on behalf of State has opposed the prayer for bail of the petitioner and submitted that there are sufficient materials against the petitioner showing his involvement in the present case, hence he does not deserve bail.

Regard being had to the facts and circumstances of the case and nature of allegation against the petitioner coupled with materials available against petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing of bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned District and Additional Sessions Judge-I, Khunti in connection with S.T. No. 57 of 2019 arising out of Murhu P.S. Case No. 74 of 2015 corresponding to G.R. No. 500 of 2015 (S).
