Heard learned counsel for the parties.
The petitioner has been made an accused in connection with Daltonganj Town P.S. Case No. 02 of 2022, registered for the offence under Section 363, 392 of the Indian Penal Code, pending in the court of learned C.J.M., Palamau.
FIR of this case was lodged against 2 unknown persons with regard to loot of Rs.3,000/- in cash, one mobile phone and also Rs.33,891/- from his bank account, by taking password of the informant.
None appears on behalf of the petitioner.
Learned A.P.P appearing on behalf of State has opposed the prayer for bail of the petitioner and submitted that there are sufficient materials against the petitioner showing his involvement in the present case, hence he does not deserve bail.
It appears that petitioner has been involved in this case on the basis of confessional statement of other co-accused and petitioner was not put on
T.I.P till today. Other co-accused person, namely, Firoj Ansari has been granted bail by the Co-ordinate Bench of this Court in B.A. No. 6599 of 2022.
Considering the facts and circumstances of the case and nature of allegation against the petitioner coupled with materials available against petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing of bail bond of Rs. 25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Palamau in connection with Daltonganj Town P.S. Case No. 02 of 2022.
