Heard learned counsel for the parties.

The petitioner has been made an accused in connection with Mohanpur P.S. Case No. 115 of 2017 corresponding to G.R. No. 730 of 2017 and S.T. No. 158 of 2017, registered for the offence under Section 147, 148, 149, 341, 323, 324, 326, 307 and 302/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge- IV, Deoghar.

As per F.I.R. allegation is that petitioner and others attacked the informant party and thereafter assaulted several persons including the deceased.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. It is submitted that both the parties are close agnates and co-villagers and there is a land dispute between both the parties. Petitioner was not present at the place of the occurrence. It is also submitted that other co-accused, namely, Ashok Rout and Mukesh Raut have been granted bail by the Co-ordinate Bench of this Court in B.A. Nos. 10649 of 2019 and 6740 of 2017 vide order dated 09.12.2019 and

04.12.2017 respectively. The petitioner is languishing in Judicial custody since 30.12.2021 without rhymes and reasons, hence, the petitioner may be enlarged on bail.

Learned A.P.P appearing on behalf of State has opposed the prayer for bail of the petitioner and submitted that there are sufficient materials against the petitioner showing his involvement in the present case, hence he does not deserve bail.

Regard being had to the facts and circumstances of the case and nature of allegation against the petitioner coupled with materials available against petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing of bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions JudgeIV, Deoghar in connection with Mohanpur P.S. Case No. 115 of 2017 corresponding to G.R. No. 730 of 2017 and S.T. No. 158 of 2017.
