The anticipatory bail application filed on behalf of petitioner, who is apprehending his arrest in connection with Giridih (T) P.S. Case No. 18 of 2022 for the offence registered under Sections 467, 468, 471, 420 of the Indian Penal Code pending in the Court of learned C.J.M., Giridih, is pressed into motion.

A written report is the basis of the case.

As per the prosecution case, three men committee was constituted which submitted enquiry report that name of Raghunandan Prasad does not figure in the appointment letter No.107(25) dated 08.03.1991 at serial No.135. It is said that on serial No.135, the name of Shashibhushan Prasad of Patna is mentioned and therefore the appointment letter submitted by Raghunandan Prasad on 08.03.1991 was found to be prima facie illegal. In view of the enquiry report, the present case has been lodged for committing forgery and cheating by tempering with the records by this petitioner.

It is submitted by the learned counsel on behalf of the petitioner that he has 31 years unblemished service record and till date no departmental proceeding has been initiated against the petitioner. The allegation of tempering with the records are false. Offences of cheating or forgery will not be made out since he had never concealed his identity.

Learned A.P.P. has opposed the prayer for bail.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioner, above named, is directed to surrender before the learned Trial Court within a period of two weeks and in the event of his arrest or surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioner will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
