05/ 26.09.2022 . Apprehending his arrest, petitioner above-named has moved this Court for grant of anticipatory bail in connection with Dhanbad (Mahila) P.S. Case No.16 of 2022 registered for the offence under Sections 498-A, 342, 504, 506 & 34 of the Indian Penal Code and under Sections 3/ 4 of D. P. Act.

As per the case of the prosecution, the marriage was solemnized in the year 2018 and thereafter it is stated that this petitioner and in-laws subjected her cruelty in reference to unlawful demand of Rs.5 Lacs.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner is an Engineer working in Wipro whereas the informant is also employed and working in private company in Hyderabad. The petitioner has also filed Divorce Suit on the ground of adultery on 15.03.2022 and this case has been filed on 13.03.2022. Both the parties were not living together since long and, therefore, question of harassment for unlawful demand does not arise.

Learned APP for the State assisted by learned counsel for the informant has vehemently opposed the prayer. It is submitted that the petitioner has intentionally suppressed the fact that he had earlier solemnized the marriage to one Ms. Phenomena who has filed a case under Section 498A against the petitioner which amounts to criminal antecedent.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under Section 438(2) Cr. P.C. and subject to further condition that the petitioner will cooperate during investigation, enquiry and trial.

The petitioner will co-operate in the investigation and will appear on notice under Section 41 A of Cr.P.C. and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
