Apprehending his arrest, petitioner- Dr. Ajeet Pal Singh Sachan @ Ajeet Pal Singh Sachan has moved this Court for grant of privilege of anticipatory bail in connection with Complaint Case No. 3815 of 2019 registered under Sections 498A of the Indian Penal Code and Sections 3/ 4 of the Dowry Prohibition Act.

Heard the parties.

It is submitted by learned counsel for the petitioner that both the parties are doctors and the dispute is only with respect to parenting right of the child born from the wedlock. The marriage took place in the year 2007 whereas the case has been filed after lapse of 12 years because of marital discord.

The Addl. P.P. assisted by learned counsel for the complainant has opposed the prayer for bail and submitted that the petitioner is subjecting the complainant to various form of mental and economic cruelty. The petitioner took a loan of Rs.8 Lakh to pay his own debt in the name of the complainant and he has also entered into her property in Kanpur and forced the complainant to sell the property in Ranchi.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of three weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C.
