04/ 26.09.2022 . Apprehending his arrest, petitioner above-named has moved this Court for

grant of anticipatory bail in connection with Complaint being PCR Case No.345 of 2021 registered for the offence under Sections 498(A), 323, 342, 406 of the Indian Penal Code and Sections 3 /4 of the D. P. Act.

Heard the parties.

As per the case of the prosecution, marriage took place in the year 2014 and thereafter a child was also born from the said wedlock. It is alleged that from the very beginning the complainant was harassed by the petitioner regarding which earlier Complaint Case being P.C.R. Case No.74 of 2017 was filed under Sections 498A, 494, 406, 504 IPC and under Sections 3 /4 D.P. Act and the same ended in compromise, but thereafter harassment was renewed.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner is innocent and has committed no offence. Petitioner is husband of the complainant and due to some oblique motive the instant case has been filed.

Learned APP for the State has opposed the prayer.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under Section 438(2) Cr. P.C.
