Petitioner has been made an accused in connection with Giridih (M) P.S. Case No. 311/2020, corresponding to Cyber Case No. 44/2021, registered under Sections 376/ 379/ 384/ 506 of the Indian Penal Code, pending in the Court of learned Additional Sessions JudgeII,Cum- Special Judge Cyber Case, Giridih.

On 03/08/2020, petitioner went to the house of the informant made her unconscious and raped her. It is alleged that he video graphed the entire occurrence and blackmailed the informant into submitting herself for sexual assault.

Learned lawyer for the state conceded that during the course of investigation police has failed to collect any material regarding the fact that occurrence was video graphed and the informant was blackmailed by the petitioner.

Learned lawyer for the petitioner submitted that there is delay of 4 months in lodging of this case, delay has not been properly explained.

Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II,Cum- Special Judge Cyber Case, Giridih in connection with Giridih (M) P.S. Case No. 311/2020, corresponding to Cyber Case No. 44/2021.
