2/ 23.03.2022 Petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Sections 302/201/34 of the Indian Penal Code in connection with Rania Police Station Case No.28 of 2019 [G.R. No.434 of 2019(S)] corresponding to Sessions Trial No.98 of 2021, pending in the Court of learned Additional Sessions Judge II, Khunti.

Heard learned counsel for the petitioners and the learned A.P.P. for the State and have also gone through the impugned order.

Defects pointed out by the Office are ignored for the present.

Son of the informant was murdered. It is alleged that informant’s son was having some relationship with a girl and had went to meet that girl. Informant suspected that the girl along with her friends has murdered her son.

From the impugned order, I find that there is no eye witness to the said occurrence. The name of the petitioner transpired from the confessional statement of the co-accused. After the arrest of the petitioner, he confessed his guilt. This is the only material against him. Petitioner is in custody since 01.02.2021 and it is submitted that chargesheet has already been submitted.

Considering the nature of material collected during investigation and the fact that there is no eye witness to the occurrence, I am inclined to grant bail to the petitioner. Petitioner, namely, Suleman Surin @ Sule is, accordingly, directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Khunti in connection with Rania Police Station Case No.28 of 2019 [G.R. No.434 of 2019(S)] corresponding to Sessions Trial No.98 of 2021.
