The anticipatory bail application filed on behalf of petitioners, who are apprehending their arrest in connection with Ranka P.S. Case No. 232 of 2021 for the offence registered under Sections 304/120B, 34 of the Indian Penal Code pending in the Court of Sri Ravi Choudhary, learned Judicial Magistrate, 1^st Class, Garhwa, is pressed into motion.

As per the prosecution case in brief as set out in the written report lodged by Shravan Bhuiyan, brother of the deceased is that on 12.09.2021 his brother Shivlal Bhuiyan left his home saying that he was going to work on the tractor of Aminuddin Ansari of his village and information was received that while working on tractor, he met with accidental death.

It is submitted by the learned counsel on behalf of the petitioners that it was a case of accidental death and the offence under Section 304 of the I.P.C. will not be made out. Further a petition has been field by the informant before the Court below that by mistake of fact this case has been lodged against these petitioners and owner of the tractor was Aminuddin Ansari of Chhattisgarh.

Learned A.P.P. has opposed the prayer for bail.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioners, above named, are directed to surrender before the learned Trial Court within a period of two weeks and in the event of their arrest or surrender, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioners will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
