2/ 10.03.2022 Petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Sections 392 of the Indian Penal Code, in connection with Torpa Police Station Case No.67 of 2021, pending in the Court of Judicial Magistrate 1^st Class, Khunti.

No one appears on behalf of the petitioner. I have gone through the entire records and have heard learned A.P.P. appearing for the State. I do not feel keeping this matter pending waiting for appearance of the counsel for the petitioner.

Defects pointed out by the Office are ignored for the present.

As per the prosecution, informant was robbed of his money by some unknown persons. Description of apparels of the accused were given in the First Information Report.

From the record, I find that the petitioner was arrested and he is in custody since 17.11.2021. Chargeshet has already been submitted in this case. From the impugned order I find that since the petitioner was wearing similar type of cloths, prosecution has implicated the petitioner in the aforesaid case. It is the case of the prosecution that the petitioner has confessed his guilt.

Considering that the material which has surfaced against the petitioner is his confessional statement and wearing similar type of cloths, and also keeping in view that chargesheet has already been submitted, I am inclined to grant bail to the petitioner. Petitioner, namely, Wakil Ansari @ Miku, is, accordingly, directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1^st Class, Khunti in connection with Torpa Police Station Case No.67 of 2021.
