2/09.03.2022 The lawyers have no objection with regard to the proceeding, which has been held through video conferencing today at 2.15 P.M. They have no complaint in respect to the audio and video clarity and quality.

Defects, pointed out by the office, are hereby ignored for the present.

Heard learned counsel appearing for the petitioner and the learned counsel for the State and have gone through the impugned order.

The petitioner is an accused for allegedly committing offence punishable under Sections 379, 414/34 Indian Penal Code.

It is alleged that during patrolling and vehicle checking, the petitioner was apprehended with a motorcycle. He could not produce any document of the motorcycle. He confessed his guilt that the motorcycle is stolen. He also confessed that he is involved in other cases where he had stolen motorcycle and the motorcycle was kept in the house. On his statement, several motorcycle were also recovered.

The petitioner is in continuous custody from 20.09.2021. Prior to that he was in custody but he was released because of the pandemic but he thereafter, surrendered.

Considering the period of custody and the fact that charge sheet has already been submitted in this case and he has surrendered after he was released, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Latehar in connection with Balumath P.S. Case No. 86 of 2021 (G.R. No. 533/2021).
