The anticipatory bail application filed on behalf of petitioners, who are apprehending their arrest in connection with Giridih (M) P.S. Case No. 362 of 2017 corresponding to G.R. No.2972 of 2017 for the offence registered under Sections 379/411 of the Indian Penal Code, Section 30(ii) of the Coal Mines Act and Sections 21/23 of the Mines and Minerals (Development & Regulation) Act, 1957 pending in the Court of learned S.D.J.M., Giridih, is pressed into motion.

As per the prosecution case, two trucks were seized with coal of both these petitioners without any valid paper.

It is submitted by the learned counsel on behalf of the petitioners that they are bona fide transporters without any criminal antecedent.

Learned A.P.P. has opposed the prayer for bail.

¶13

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioners, above named, are directed to surrender before the learned Trial Court within a period of two weeks and in the event of their arrest or surrender, they shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioners will deposit Rs.50,000/- each in the Court below as security amount.

The petitioners will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
