that the writ petition may be rendered to be infructuous as for the same issue a suit being T.S. No.212 of 2009 is pending before the competent court of jurisdiction in between the same parties where the suit is at the stage of evidence.
Considering the aforesaid reason, let this writ petition be rendered to be infructuous, accordingly disposed of.
