The instant contempt case has been filed against the opposite party no.2 for alleged, willful and deliberate non-compliance of the order dated 23.09.2019 passed in W.P.(S) No.4392 of 2019.
Mr. Someshwar Roy, learned counsel for the petitioner submits that the order passed by the writ Court has not been complied with.
Mr. Mahavir Pd. Sinha, learned counsel appearing for the Jharkhand Mineral Area Development Authority has submitted that the amount has been calculated as also sanctioned and within the period of three weeks from today, the said amount will be disbursed in favour of the petitioner. In view of such submission, he further submits that the matter may be disposed of.
Upon this Mr. Someshwar Roy, learned counsel for the petitioner submits that appropriate order may be passed and the matter may be disposed of.
This Court, after having heard the learned counsel for the parties and taking into consideration the submissions made on their behalf, deems it fit and proper to dispose of the instant contempt case considering the undertaking furnished by Mr. Mahavir Pd. Sinha, learned counsel appearing for the Jharkhand Mineral Area Development Authority for disbursement of the amount in favour of the petitioner within the period of three weeks from today.
In view thereof, the instant contempt case is finally closed, accordingly, disposed of.
