The present writ petition is taken up today through Video conferencing.
The present writ petition has been filed for quashing letter no. 1848 dated 14.08.2020 (Annexure-7 to the writ petition) issued by the respondent no. 3 by which the petitioner has been informed regarding termination of the work order earlier issued to it vide letter no. 269 dated 25.01.2019 in pursuance of biding document no. 39/2018-19 dated 04.01.2019.
A counter affidavit has been filed on behalf of the respondents sworn by one Narayan Oraon- Medical Officer, Mahatma Gandhi Memorial Medical College Hospital, East Singhbhum stating in paragraph-19 that the E-Tender notice relating to Tender No. 1675 dated 21.07.2020, has been stayed till further orders. A notice relating to tender as contained in letter no. 1918 dated 28.08.2020 has been issued by the respondent no. 3 to that effect. Moreover, vide letter no. 1922 dated 28.08.2020, earlier order issued vide letter no. 1848 dated 14.08.2020 (impugned herein) by which the contract of the petitioner-firm was terminated, has been ordered to be cancelled and the petitioner-firm has been directed to continue the work as per the existing work order/agreement.
Mr. P.A.S. Pati, learned G.A.-II appearing on behalf of the respondents submits that the period of agreement dated 31.01.2019 has already come to an end.
Be that as it may. Keeping in view the aforesaid development, as stated in the counter affidavit filed by the respondents, there is no need to further proceed with the present writ petition and the same is accordingly disposed of.
I.A. No. 6573 of 2020 also stands disposed of accordingly.
