The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities were good.

Since the present interlocutory application is superficious in the nature, the same

is, hereby, dismissed.

Heard learned counsel for the petitioner and the State.

The present revision petition has been filed against the order dated 06.03.2020 passed in S.T. No. 126 of 2018 in connection with Charhi P. S. Case No. 01 of 2018 corresponding to G. R. No. 01 of 2018 wherein prayer of the petitioner for recall of the witnesses P. W.-1, P. W.-2 and P. W.-3 for further cross-examination has been denied. Petitioner has been charged under Section 498A/34, 304(B)/34 and 302/34 of the Indian Penal Code.

It has been submitted by the learned counsel for the petitioner that both the parties have compromised the case. P. W.-1, P. W.-2 and P. W.-3 are ready to make statement in the Court below and for that purpose, they require further cross- examination in this case.

From perusal of the records, it appears that learned trial Court has rejected the prayer by holding that the offences under which the petitioner has been charged, are non compoundable and witnesses can be recalled only to elicit the truth and not to compromise the offences, which are otherwise non compoundable.

Accordingly, this Court finds no merit in the present revision petition and the same is, hereby, dismissed.
