The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities were good.

06/19.07.2021 Heard learned counsel for the appellants and the State.

In spite of valid service of notice, nobody appears on behalf of the victim.

The appellants have preferred this appeal under Section 14-A of the SC/ST (POA) Act being aggrieved and dissatisfied by the order dated 15.10.2020 passed by learned Special Judge, SC/ST (POA) Act, Palamau at Daltonganj in M.C.A. No. 808 of 2020 in connection with Hariharganj P. S. Case No. 68 of 2020, whereby the bail of the appellants were rejected.

It has been argued by the learned counsel for the appellants that the appellants are in custody since 23.07.2020. Investigation is complete and charge sheet has already been filed and they are ready to co-operate with the trial. Further there is scuffle between the parties and minor injuries have been reported to the victim. On the above fact, prayer for bail has been made.

Learned counsel for the State has opposed the prayer.

In the attending facts and circumstances of the case and considering the period of custody, the appellants are directed released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Special Judge, SC/ST (POA) Act, Palamau at Daltonganj in connection with Hariharganj P. S. Case No. 68 of 2020 subject to the conditions that the appellants will submit self attested copy of their Aadhar Card and also give their mobile number before the learned court below which they will not change during pendency of the case without prior permission of the court.

Accordingly, the instant appeal is allowed and the impugned order dated 15.10.2020 passed by learned Special Judge, SC/ST (POA) Act, Palamau at Daltonganj in M.C.A. No. 808 of 2020 in connection with Hariharganj P. S. Case No. 68 of 2020 is, hereby, set aside.
