The matter was taken up through Video Conferencing. Learned counsel for the parties had no objection with it and submitted that the audio and video qualities are good.

1. The present revision application has been filed against the order dated 28.05.2021, passed by the court of learned Additional Sessions Judge – I -cum- Special Judge, Jamtara, in Criminal Appeal No.08 of 2021, by which the prayer for bail of the petitioner has been rejected in connection with Jamtara Cyber Crime P.S. Case No.35 of 2019, registered for the offence under Sections 414, 419, 420, 467, 468, 471 of the Indian Penal Codd and Section 66(B), (C), (D) of the Information Technology Act.

2. It has been submitted by the learned counsel for the petitioner that the juvenile is in custody since 23.12.2020 and the investigation has been completed. The juvenile has approached this Court trough his mother, who is ready and willing to maintain and keep the juvenile in her proper custody and care. It has further been submitted that the juvenile is interested in pursuing his further studies. On the above facts, prayer for bail of the juvenile has been made.

3. On the other hand learned A.P.P has opposed the prayer for bail.

4. Perused the Social Investigation Report. Considering the fact that the mother of the petitioner is ready to keep the petitioner in her proper custody and care and further, considering the mandate of Section 3 of the Juvenile Justice

(Care and Protection of Children) Act, 2015, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.35 of 2019, subject to the condition that one of the bailors must be the mother of the juvenile.

Further, concerned Probation Officer is directed to report, once in a month, to the Juvenile Justice Board, Jamtara regarding the upkeeping of minor.

5. Accordingly, the instant criminal revision is allowed and the impugned order dated 28.05.2021, passed by the court of learned Additional Sessions Judge – I -cum- Special Judge, Jamtara, in Criminal Appeal No.08 of 2021, is hereby, set aside.
