Though the notice was issued to the Opposite Party no. 2 and the same has been served yet no one turns up for the opposite party no. 2 even after repeated calls.

Apprehending her arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Complaint Case No. 1268 of 2018 registered under sections 420/406/468/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has taken an advance of Rs.2,00,000/- and subsequently also took Rs.2,50,000/- and Rs.1,50,000/- respectively thus in total she has received Rs.6,00,000/- in total but she is neither selling her land nor returning the money to the complainant. It is further submitted that the allegation against the petitioner are false and she has not taken any money whatsoever nor any document has been attached by the complainant with the complaint to show entrustment of any money to the petitioner. It is next submitted that the petitioner is ready to co-operate with the trial of the case hence, the petitioner be given the privilege of anticipatory bail.

The learned Addl. PP opposes the prayer for anticipatory bail of the petitioner.

Considering aforesaid facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the

petitioner. Hence, in the event of arrest by the police or surrender within a period of six weeks from the date of this order, the petitioner shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Giridih in connection with Complaint Case No. 1268 of 2018 subject to the condition that the petitioner will co-operate with the trial of the case along with the other conditions laid down under section 438 (2) Cr. P.C.
