industry in the name and style of M/s. Mica Mould in the same premises but in a separate portion, of course, without any boundary segregating the two units. It is also submitted that the allegation of forging of documents is vague as it has not been specifically pleaded as to in what manner and in which documents are forged and no cognizance for the offence of forgery has been taken by the learned Magistrate and the learned Magistrate has taken cognizance for the offences punishable under Section 406 and 379 of Indian Penal Code only. It is also submitted by Mr. Sinha, that the dispute between the parties is basically a civil dispute and there is no allegation of any dishonest intention on the part of the petitioner at the time of alleged authority being given to him by the complainant. It is then submitted by Mr. Sinha, that the complainant along with the six sisters of the petitioner executed a special power of attorney in favour of the petitioner to look after the legal matters of the Gulabrai Manoharlal Company Limited in connection with Company Petition along with other cases pending before the Hon’ble Calcutta High Court and subsequently, the Hon’ble Calcutta High Court directed dissolution of the company and further appointed fresh Joint Special Officer in ACO No.19 of 2006 arising out of APO No.209 of 2002. It is then submitted that the petitioner undertakes to cooperate with the trial of the case and also undertakes that he will not go to the portion of the factories namely M/s. Metal Seals Industries and Nutech Chemicals Limited during the pendency of the case and he will not cause any hindrance to the complainant or any of his agents or authorized persons to enter the portion of the said two industries. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail.
