The petitioner is an accused in connection with Telaiya P.S. Case No. 56 of 2021.
It has been alleged that by creating fake profile on Facebook of S.P. Koderma, a request was made to transmit the messages to the people for sending money on Phone Pe/Paytm on mobile no. 9517388059. In course of enquiry, it was detected that subscriber of the said mobile is one Sanjay of Bareilly, U.P. It has further been alleged that Paytm A/c No. 919517388059 was prepared in the name of Jag Prasad and from this account, several transactions have been made in the account of one Jarina and in the account of one Rukshina.
It has been submitted by the learned counsel for the petitioner that subscriber of the mobile was Sanjay and not the present petitioner. It has further been submitted that the petitioner does not have any criminal antecedent and he is in custody since 22.3.2021.
Learned Special P.P. has opposed the prayer for bail made by the petitioner and has submitted that one of the account numbers, in which, allurement has been given for deposit of money, was in the name of the wife of the present petitioner. He, however, submitted that not a single person was cheated on account of the act of the accused persons.
On consideration of the period of custody undergone by the petitioner and the submissions, noted above, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No. 56 of 2021, subject to the condition that one of the bailers should be a close relative of the petitioner.
