Heard learned counsel for the petitioner and learned counsel for the State. Case diary, called for, has been received. Perused the same.
The petitioner has been made accused in connection with Rania P.S. Case No.28 of 2019, corresponding to G.R Case No.434 of 2019 for the offence under Sections 302, 201, 34 of the Indian Penal Code, pending in the Court of learned S.D.J.M., Khunti.
It is alleged that on 14.08.2019, Md. Afjal, the son of the informant was murdered by some unknown persons. Suspicion has been raised upon the girl, who was having love affairs with the deceased of having conspired the commission of his murder. During the course of investigation, it came to light that the family members of the girl had opposed the relationship between her and the deceased as they belonged to different religions.
The name of the petitioner has come on the basis of confessional statement of the co-accused persons. There is no direct allegation of assault against the petitioner.
Considering the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Khunti, in connection with Rania P.S. Case No.28 of 2019, corresponding to G.R Case No.434 of 2019.
