So far as defect no. 5 (e) is concerned, learned counsel for the petitioner undertakes to remove the same, within a period of one week. As regards, the rest defects are concerned, the same are ignored.
The petitioner is an accused in connection with Khunti P.S. Case No. 201 of 2020 corresponding to POCSO Case No. 7 of 2021.
It has been alleged that the petitioner was suspected to have enticed away the daughter of the informant.
The statement under Section 164 Cr.P.C. of the victim has been recorded in paragraph 75 of the case diary, from which it appears that she was having a love affair with the petitioner for the last one year and physical relationship was also established between them. She has further stated that on 30.11.2020, she had gone with the petitioner to the house of his sister, where she had stayed for two days.
It appears from a perusal of the statement under Section 164 Cr.P.C. of the victim that she was having a love affair with the petitioner which culminated in establishing physical relationship between them. The petitioner is in custody since 04.12.2020.
Regard being had to the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned POCSO Judge cum District & Additional Sessions Judge Ist, Khunti in connection with Khunti P.S. Case No. 201 of 2020 corresponding to POCSO Case No. 7 of 2021.
