The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

04/22.03.2021: Heard learned counsel for the petitioners and learned counsel for the State.

The present application has been filed for grant of regular bail to the petitioner in connection with Shikaripara P.S. Case No.49 of 2020 corresponding to G.R. Case No.530 of 2020, registered Sections 147, 148, 149, 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that the petitioner nos.1 & 2 are in jail custody since 12.05.2020 and petitioner nos.3 & 4 are in jail custody since 14.05.2020 and 13.05.2020 respectively. Investigation is complete. The petitioners are ready to cooperate with the trial. Further, the FIR has been lodged against 50 to 60 person including 11 named persons. The petitioners are named in the FIR. It has been submitted that one of the named persons namely Biren Rajwar has been granted bail by the co-ordinate bench of this Court vide order dated 02.11.2020 passed in B.A. No.6027 of 2020. It has been further submitted that there was an earlier case being Kathikund P.S. Case No.28 of 2020 regarding the same incident. On the basis of above facts, the prayer for bail has been made.

On the other hand, counsel for the State has opposed the prayer for bail and has submitted that there are confessional statement of the accused and on their confessional statement “ Dandas ” were recovered, and as such, they do not deserve bail.

Considering the material available on record and the argument of the parties, it appears that the investigation is already complete and there is general and omnibus allegation against 50 to 60 persons regarding the assault to the deceased for stealing goat and the similarly situated co-accused has already been granted bail by the co-ordinate bench of this Court, the petitioners, named above, are directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dumka in connection with Shikaripara P.S. Case No.49 of 2020 corresponding to G.R. Case No.530 of 2020, subject to condition that the petitioners will submit self-attested photocopies of their Aadhar Card and also submit their mobile numbers before the learned court below which they will always keep active and will not change them during pendency of this case without prior permission of the court.
