Pursuant thereto, the system generated sale certificate i.e. Form21 and was issued in the name of buyer and the vehicles were also insured on 31st March, 2020 by M/s. National Insurance Co. Ltd. and Oriental Insurance Co. Ltd. on the same day i.e. 31st March, 2020. The petitioner immediately approached the office of the respondent no.3 for registration of the vehicles, but due to countrywide lockdown, all the government officials of the District Transport Office, Ranchi were deployed in Covid-19 duty and the entire office was non-functional, thus, the registration of the said vehicles could not take place. It is further submitted that in the second phase of the lockdown in the month of April, 2020 when some relaxation was given, the District Transport Office, Ranchi started functioning. The petitioner again approached the District Transport Office through e-mail dated 24th April, 2020 and the same was informed through telephone to the officials but its application for registration of the vehicles was denied on 27th April, 2020 verbally and the petitioner was handed over a copy of letter no.747 dated 24th April, 2020 issued by the Respondent no.2 addressed to the State Informatics Officer, National Informatics Centre, Ranchi, wherein clarification with regard to registration of BSIV vehicles was discussed in the light of the order dated 27th March, 2020 passed by the Hon’ble Supreme Court. The District Transport Officer, Ranchi in terms with the discussion made in the said clarification has denied registration of the vehicles. It is further submitted that the respondent no.3 by orally denying the registration of the BS-IV commercial vehicles of the petitioner, which were sold on 31st March, 2020, is completely arbitrary and illegal. The respondent no.3 has not even followed the clarification dated 24th April, 2020 issued by the respondent no.2 in pursuance of the order dated 27th March, 2020 passed by the Hon’ble Supreme Court in the aforesaid writ petition.
