Indrajeet Kumar Paswan Alias Indrajit Kumar Adisan Vs the State of Jharkhand

Learned counsel for the petitioner submits that the petitioner’s prayer for bail was earlier rejected by this Court vide order dated 24.07.2019 passed in B.A. No. 4086/2019. By way of present bail application, the petitioner has renewed his prayer for bail primarily due to the reason that the petitioner is in judicial custody since 13.09.2018 and there is no positive progress in the trial. Hence, the petitioner may be given the privilege of regular bail.

Learned A.P.P while opposing the petitioner’s prayer for bail, submits that he has committed rape upon the victim girl, who at the time of the alleged occurrence was aged about 14-16 years. The petitioner’s prayer for bail was earlier rejected by this Court on merit. The petitioner has not made out any fresh ground, except the length of judicial custody, for reconsideration of his prayer for bail. Therefore, he may not be given the privilege of regular bail.

Considering the facts and circumstances of the case, I am not inclined to reconsider the petitioner’s prayer for bail in connection with Chhattarpur (Mahila) P.S. Case No. 06/2018.

Accordingly, the prayer for bail of the above named petitioner is rejected. However, the Trial Court is directed to expedite the trial and conclude the same without any undue delay.
