Heard learned counsel for the petitioner and learned counsel appearing for the State.
Through this application, the petitioner has prayed for modification of the order dated 13.04.2017 passed in A.B.A. No. 2051 of 2017. The petitioner in the said order was granted four weeks’ time to surrender and on deposit of Rs. 10,000,/- he was directed to be released on bail. The petitioner has claimed that since he was engaged since 2017 with the treatment of his father, he could not surrender within the time specified by this Court and, accordingly, the date of surrender be further extended by modifying the order dated 13.04.2017.
The petitioner in support of his contention has brought on record various medical prescriptions and which thus substantiates the statement advanced by the learned counsel for the petitioner.
Since a reasonable explanation has been submitted by the petitioner for extending the period of surrender, the order dated 13.04.2017 passed in A.B.A. No. 2105 of 2017 is, accordingly, modified to the extent that the petitioner is granted further two weeks’ time to surrender in terms of the said order and on his surrender he shall be released on bail subject to the fulfillment of the conditions as enumerated in the order dated 13.04.2017. It is made clear that modification has been allowed only with respect to extension of the date of surrender and no further.
This application stands disposed of.
