The petitioner has been made accused in connection with Murhu P.s. case no. 05 of 2015 instituted under sections 147, 148, 149, 302 of the Indian Penal Code, section 27 of Arms Act, and section 17 of CLA Act. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in murder of the daughter of the informant and from the local, people the informant came to know that the extremist of MCCI along with 4-5 unknown person, killed the daughter of the informant. It is then submitted by learned counsel for the petitioner that the allegation against the petitioner is false and the petitioner has been implicated in this case on the basis of the confessional statement of the co-accused persons. It is further submitted by learned counsel for the petitioner that the petitioner has been in jail custody since 18.02.2019 as mentioned in paragraph 15 of the bail application and the petitioner is ready and willing to co-operate with the trial of the case and co-accused with similar allegations have already been released on bail by a coordinate Bench of this court vide order dated 28.08.2019 passed in BA no. 5500 of 2019 hence, the petitioner may be released on bail. Learned Addl. P.P. opposes the prayer for bail of the petitioner.
