The petitioner has been made accused in connection with Dhansar P.s. case no. 96 of 2017 (G.R. No. 1782 of 2017) instituted under sections 302/34 of the Indian Penal Code but charge sheet has been submitted for the offence punishable under Section 306 of the Indian Penal Code.

Learned senior counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner has abetted the suicide of his wife. It is then submitted by learned senior counsel for the petitioner that the allegation against the petitioner is false. It is further submitted by learned senior counsel for the petitioner that there is no material in the record to suggest that the petitioner has done any overt act to abet the suicide of the deceased and the quarrel that used to take place between the petitioner and the deceased was the normal wear and tear in the marital relationship more so, when the petitioner was not financially sound. It is further submitted by learned senior counsel for the petitioner that the there is no eye witness to the occurrence and in fact, the deceased was married with one Suresh Kumar Ram who is still alive and hence, there is no question of petitioner marrying the deceased daughter of the informant and the two children of the deceased were born out of wedlock of the deceased with the said Suresh Kumar Ram. It is further submitted by learned senior counsel for the petitioner that the petitioner has been in jail custody since 01.06.2020 as mentioned in paragraph 22 of the bail application and the petitioner is ready and willing to co-operate with the trial of the case hence, the petitioner may be released on bail.

Learned P.P. opposes the prayer for bail of the petitioner.

Considering the facts of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1^st class, Dhanbad in connection with Dhansar P.s. case no. 96 of 2017 (G.R. No. 1782 of 2017) subject to the condition that the petitioner will co-operate with the trial of the case.
