So far as defect nos. 4, 5 ( e), 6 ( c), 9 (i) to 9 (iv) are concerned, learned counsel for the petitioner undertakes to remove the same once the situation normalises. As regards the rest defects are concerned, the same are ignored.
The petitioner is an accused in connection with Radhanagar P.S. Case No. 44 of 2018, G.R. No. 346 of 2018.
Earlier prayer for bail of the petitioner was rejected by this Court twice in B.A. No. 9407 of 2018 and B.A. No. 1015 of 2020.
In B.A. No. 1015 of 2020, the petitioner was given a liberty to renew his prayer for bail if the trial is not concluded within a period of two months.
It appears that out of 11 witnesses, nine have been examined as yet. The petitioner is in custody since 22.07.2018.
Regard being had to the period of custody and the fact that the trial has not been concluded, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Rajmahal in connection with Radhanagar P.S. Case No. 44 of 2018, G.R. No. 346 of 2018.
