Petitioner seeks restoration of W.P.(S) No.7380 of 2017 which was dismissed for default due to non-compliance of the peremptory order dated 26.09.2018 passed in a batch of writ petitions.
Learned counsel for the petitioner submits that the writ petition relates to post-retirement dues. Because of pure inadvertence, the surviving defects could not be removed within the peremptory time. However, petitioner would suffer irreparably, if the writ petition is not restored as he is not at fault.
There is no objection to the prayer by the learned counsel for the opposite parties.
Having considered the explanation urged on behalf of the petitioner and the submissions of the parties, W.P.(S)No.7380/2017 is restored to its original file. Let the surviving defects in the writ petition be removed within a period of three weeks. The instant petition stands disposed of.
