02/ 04.09.2020 Mr. Pravin Kumar, learned counsel for the petitioners and Mr. Prabir Kumar Chatterjee, Special Public Prosecutor for the State are present through Video Conferencing.
Petitioners have prayed for extension of time to fulfil the condition laid down under order dated 20th May, 2020 passed in A.B.A. No. 244 of 2020. By the instant order, it was directed that in the event of their arrest or surrender within a period of 4 weeks, they shall be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each, however subject to further condition that they would make payment of Rs. 15,000/- each in the Chief Minister’s Relief Fund. Petitioners have stated that due to sudden increase of Covid-19 and the lock down operating in different stages, petitioners despite their best efforts could not manage to deposit the aforesaid amount. They seek reasonable extension of time to comply with the aforesaid condition with appropriate modification in the order dated 20th May, 2020.
Having considered the submission of learned counsel for the petitioners, learned Special Public Prosecutor for the State and the reasons explained, time for complying the condition of deposit of Rs. 15,000/- and surrender before learned Trial Court, is extended upto 30th September, 2020. On failure to do so, the Investigating Officer would take steps for apprehension of the accused-petitioners in accordance with law and also submit a report to this Court within 4 weeks thereafter in the instant A.B.A. matter.
Let a copy of this order be communicated to Superintendent of Police, West Singhbhum at Chaibasa apart from learned trial court.
With the aforesaid modification in the order dated 20th May, 2020 passed in A.B.A. No. 244 of 2020, the instant petition is disposed of.
