This criminal miscellaneous petition has been filed under section 482 Cr.P.C by the petitioners with a prayer for modification of the order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018.
It is submitted by the learned counsel for the petitioners that vide order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018, the petitioner was directed to surrender before the court below within six weeks but due to shortage of money, he could not collect Rs.5,50,000/- which was to be deposited with the Bank of India, Barhi Branch, Hazaribag, in terms of the said order. It is next submitted that the petitioner in the meanwhile has collected the money and has deposited the money with the Bank of India, Barhi Branch, Hazaribag, a copy of which has been annexed at page no.6 (Annexure-2) of the supplementary affidavit, hence, time to surrender before the court below in terms of the order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018 be extended for four weeks from the date of this order.
Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018 is allowed. Hence, the petitioner is directed to surrender before the court below “within
four weeks from the date of this order in terms of the order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018”.
The order dated 23.01.2019, passed in A.B.A. No. 8164 of 2018is modified to the aforesaid extent only.
This criminal miscellaneous petition is disposed of accordingly.
