Apprehending his arrest in connection with Complaint Case No.45 of 2018 instituted under Sections 2, Sub-Section 4(b) (i) (ii), 26, 41, 42, 52 and 64 of the Indian Forest Act, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner is the owner of a pick-up van bearing registration No.JH05BA-7509 which was found collecting leaves after cutting the same from saal plants causing loss of revenue of Rs.33,000/-. It is submitted that the allegation against the petitioner is false. It is then submitted that the petitioner had no knowledge of his vehicle being involved in any illegal activity. It is lastly submitted that the petitioner is ready and willing to deposit Rs.33,000/- with the District Forest Officer, Kolhan Forest Division, Chaibasa. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned C.J.M., Chaibasa within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail showing proof of deposit of Rs.33,000/- with the District Forest Officer, Kolhan Forest Division, Chaibasa and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Chaibasa in

connection with Complaint Case No.45 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
