Heard Mr. Tejo Mistry, learned counsel for the petitioner and Mr. Sanjay Kumar Srivastava, learned A.P.P. for the State.

Petitioner has been made accused in connection with S. T. No. 82 of 2007 arising out of Adityapur P.S. Case No. 272 of 2005 corresponding to G. R. No. 888 of 2005(S).

This is a case of misuse of privilege of bail granted to the petitioner by this Court in B.A. No. 5358 of 2006 on 06.09.2006. On account of non-appearance of the petitioner, the bail bond of the petitioner was cancelled on 11.01.2012 and on 12.02.2015 he was declared as an absconder. The petitioner is in custody since 17.07.2019.

Regard being had to the period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II, Seraikella, in connection with S. T. No. 82 of 2007 arising out of Adityapur P.S. Case No. 272 of 2005 corresponding to G. R. No. 888 of 2005(S) subject to the condition that he shall remain physically present before the learned trial court on each and every date till the conclusion of the trial .
