02/21.11.2019 Heard learned counsel for the petitioner and learned A.P.P. for the State. Accused- Ashok Jaiswal is in custody in a case registered under Sections 302/120-B/34 of the Indian Penal Code in connection with S.T. No.157 of 2019 arising out of Gumla P.S. Case No.12 of 2019 corresponding to G.R. No.263 of 2019.

It is submitted on behalf of the petitioner that earlier the prayer for bail of petitioner was rejected vide order dated 24.07.2019 passed in B.A. No.3342 of 2019. It is also submitted that co-accused Sarfaraz Alam @ Deoraj @ Dablu @ Md. Sarfaraz Alam was granted bail by Bench of this Court in B.A. No.5321 of 2019 vide order dated 29.08.2019, co-accused Minnat Khan was granted bail by Bench of this Court in B.A. No.4863 of 2019 vide order dated 29.08.2019 and co-accused Lakshman Singh @ Laxman Singh has been granted bail by Bench of this Court in B.A. No.8522 of 2019 vide order dated 23.10.2019. It is also submitted that after framing of charge only two witnesses have been examined so far and five witnesses are remained to be examined.

Learned A.P.P. for the State opposed the prayer for bail and submitted that this petitioner was conspirator whose prayer for bail was earlier declined by this Court. He also submitted that material witnesses are yet to be examined.

Considering the above submissions of the parties as well as that coaccused- Sarfaraz Alam @ Deoraj @ Dablu @ Md. Sarfaraz Alam, Minnat Khan and Lakshman Singh @ Laxman Singh have already been granted bail and taking into account the period of detention of this petitioner since 13.02.2019, accused- Ashok Jaiswal is directed to be released on bail on furnishing bail bond of Rs.25,000/(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of court of Additional Sessions Judge VI, Gumla in connection with S.T. No.157 of 2019 arising out of Gumla P.S. Case No.12 of 2019 corresponding to G.R. No.263 of 2019 with condition that he will appear before the court below on each and every date before the trial court and even a single default, the bail of this petitioner shall be treated as cancelled.
