Apprehending his arrest in connection with Jamua P.S. Case No.107 of 2017 corresponding to G.R. No.1328 of 2017 instituted under Sections 147/341/323/337/447/504/353 of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submits that the allegations against the petitioner are all false and general and omnibus in nature. The petitioner has no criminal antecedent. It is further submitted that the petitioner undertakes to co-operate with the investigation of the case and he further undertakes that he will not go over the place of occurrence land during the pendency of this case. It is lastly submitted that other co-accused persons, with similar allegations, have already been given the privileges of anticipatory bail by a co-ordinate Bench of this Court vide order dated 21.03.2018 passed in A.B.A. No.1394 of 2018. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned Sub Judge-II-cum-J.M., Giridih within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-II-cum-J.M., Giridih in connection with Jamua P.S. Case No.107 of 2017 corresponding to G.R. No.1328

of 2017 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and will not go over the place of occurrence land until and unless any order is passed in his favour by any competent court of law and the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
