Heard learned counsel for the petitioner and counsel for the
State.
Petitioner is accused in connection with S.T. No.76 of 2018 registered under Sections 302, 307, 326, 120B and 34 of the IPC and Sections 3, 4 & 5 of the Explosive Substances Act.
Earlier prayer for bail of the petitioner has already been rejected twice by this Court vide order dated 06.06.2018 in B.A. No.4438 of 2018 and order dated 26.10.2018 in B.A. No.7239 of 2018. While rejecting the prayer for bail, the trial court was directed to conclude the trial within nine months.
A report has been called for from the trial court. From perusal of the report, it appears that 18 witnesses have already been examined and 21 more witnesses have to be examined in the present case.
Since the trial is going on, I am not inclined to enlarge the petitioner on bail. Accordingly, the bail application of the petitioner is, hereby, rejected.
However, the trial court is directed to conclude the trial within six months.
