Apprehending their arrest, the petitioners have moved this Court

for grant of privilege of anticipatory bail in connection with Piparwar, P.S. Case No. 41/2018 corresponding to G.R. Case No. 1024/2018 registered under Sections 143, 341, 323, 307 and 120B of the Indian Penal Code.

Heard the parties.

Learned counsel for the petitioners submits that he does not want to press the anticipatory bail of the petitioner no. 2 namely Paresh Uraon and petitioner no. 4 namely Naresh Uraon as they have already been arrested.

Hence, the prayer for anticipatory bail of the petitioner no. 2 namely Paresh Uraon and petitioner no. 4 namely Naresh Uraon is rejected as not pressed.

It is further submitted by the learned counsel for the petitioners that the allegation against the petitioners is vague and omnibus in nature. It is next submitted that the allegation against the petitioners is false. It is further submitted that the petitioners are ready and willing to pay ad interim victim compensation and undertake to cooperate with the investigation of the case. Hence, it is submitted that the petitioners be given the privilege of anticipatory bail.

The learned Addl. P.P. opposes the prayer for anticipatory bail.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that this is a fit case where the petitioner nos. 1,3,5,6,7,8,9,10,11,12,13,14,15,16 and 17, named above, be given the privilege of anticipatory bail. Hence, in the event of their arrest or surrender within a period of four weeks from the date of this order, they shall be released on bail on each of them depositing two demand drafts Rs. 2500/- each separately drawn in favour of the victims- Hiralal Uraon and Boley Uraon as ad interim victim compensation and furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra, in connection with Piparwar P.S. Case No. 41 of 2018 corresponding to G.R. Case No. 1024 of 2018 subject to the condition laid down under section 438 (2) Cr. P.C. with further conditions:

I. the petitioners will co-operate with the investigation,

II. the petitioners will appear before the Investigating Officer as and when noticed.

In case the petitioners deposit the aforesaid amount, the court below is directed to issue notice to the victims- Hiralal Uraon and Boley Uraon and on their proper identification, the court below shall release the aforesaid amount in favour of the victim.
