Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Hirodih P.S. Case No. 51 of 2017 (MC.A. No. 151 of 2018) registered under sections 384/109 of the Indian Penal Code and under Section 7/13 of the P.C. Act, 1988.

Heard the learned counsel for the petitioner and learned counsel for the Anti-Corruption Bureau.

The Learned counsel for the petitioner submits that the allegation against the petitioner is that he demanded money for appointment of one Gayatri Devi as Poshan Sakhi is false because the petitioner was no point of time any way posted or associated with any authority to influence the appointment of any Gayatri Devi as Poshan Sakhi in any Aagan Bari Kendra. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail.

Learned counsel for the Anti-Corruption Bureau has submitted a copy of the statement of the petitioner recorded by the Investigating Officer in terms of the order dated 18.09.2018 in this case and before the I.O. the petitioner has stated that he was not posted in the office of C.D.P.O. or any other department of the Government and he does not know Gayatri Devi. He further submits that there is no material in the case diary to suggest that the petitioner is a Government Servant or any way associated with

any post of the authority to influence selection of any person as Poshan Sakhi in any Aagan Bari Kendra.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Dhanbad or its successor court, in connection with Hirodih P.S. Case No. 51 of 2017 (MC.A. No. 151 of 2018) with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him subject to the conditions laid down under section 438 (2) Cr. P.C.
