Heard the learned senior counsel appearing for the petitioner and the learned APP appearing for the State.
Petitioner is an accused in connection with Garhwa P.S. Case No. 125 of 2018, (G.R. Case No. 641/2018).
It has been alleged that for the financial year 2016-17 under the Prime Minister Rojgar Yojna the first instalment was released in favour of the beneficiaries. Some beneficiaries did not get the amount. One Akram Ansari himself opened a fake account and by hacking the software had transferred the amount into the fake account. The petitioner was also named as a conspirator. The petitioner appears to be a clerk in Block Office.
It has been stated that based on the said enquiry several cases have been instituted against the petitioner. Learned senior counsel has also referred to an order dated 13.03.2019 passed in B.A. No. 796 of 2019 in which the petitioner has been granted bail in connection with Dhurki P.S. Case No. 24 of 2018.
Learned APP has opposed the prayer made by the petitioner.
It appears that several cases have been instituted against the petitioner that he in connivance with the other persons including one Akram Ansari had diverted the amount which was meant for the beneficiary under the Prime Minister Rojgar Yojna. The common enquiry report seems to be the genesis of all the First Information Report instituted against the petitioner including the present case.
It appears that the petitioner is in custody since 29.09.2018 and in similar circumstance he has been granted bail vide order dated 13.03.2019 passed in B.A. No. 796 of 2019 in connection with Dhurki P.S. Case No. 24 of 2018.
Regard being had to the above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Garhwa P.S. Case No. 125 of 2018, (G.R. Case No. 641/2018), subject to the condition that the petitioner shall remain physically present on each and every date before the learned trial Court till conclusion of trial.
