06 / 04.02.2019. Heard learned counsel appearing for the petitioners and learned A.P.P. for the State.

The petitioners are accused for offence under Sections 147, 149, 341, 323, 353 and 152 of the Indian Penal Code, prays for anticipatory bail expressing apprehension of their arrest in connection with Daru P.S. Case No. 08 of 2014 .

Learned counsel appearing for the petitioners has submitted that there is no specific allegation against the petitioners.

Learned counsel appearing for the petitioners has further submitted that altogether ten persons have been made named accused in a case where the Police has faced some opposition from the residents.

Learned counsel appearing for the petitioners has submitted that Chawkidar bearing No.4/4, Vanshi Ram has categorically stated in his written statement made under Section 161 Cr.P.C. that he has fallen down because of commotion and sustained injuries for which the Doctor has given only medicines.

Learned counsel appearing for the petitioners has further submitted that no force has been alleged against these petitioners nor corresponding injury has been found on the Chawkidar. Under the aforesaid conditions, the petitioners may be enlarged on bail.

Learned counsel for the State has opposed the prayer for bail, but after going through the case diary, has not disputed the factual aspect of the matter.

Regard being had to the facts and circumstances, the petitioners, abovenamed, are directed to surrender themselves before the court below within four weeks from today, and on their surrender, they shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribag, in connection with Daru P.S. Case No. 08 of 2014 corresponding to G.R. No. 3985 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. and subject to further condition that the petitioners shall remain physically present before the court below on each and every date till framing of charge.
