03 / 01.02. 2019. Both the applications are arising out of common First Information Report, as such, both are being heard together and disposed of.

Heard learned counsel appearing for the petitioners and learned A.P.P. for the State.

The petitioners are accused in connection with Sadar P.S. Case No.892 of 2013 under Section 307/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added after death of the victim.

Learned counsel appearing for the petitioners has submitted that the occurrence is of dated 22.10.2013. When the injured became unconscious and has not regained his consciousness, after a great delay on 16.11.2013, the First Information Report has been lodged against the petitioeners. He has further submitted that the investigation is still continuing even after a lapse of approximately five years, nothing has been collected by the Investigating officer, as such, the petitioners deserve to be enlarged on bail.

Learned counsel appearing for the petitioners has further submitted that the petitioners have surrendered on 20.11.2018.

Learned counsel appearing for the State while opposing the prayer for bail, has submitted that on 26.11.2018, the case is only pending for final order by the competent authorirty so as to submit charge-sheet.

After perusing the materials brought on record that the occurrence is dated 22.10.2013 and the F.I.R. has been lodged on 16.11.2013 as well as considering the fact that the informant has not disclosed as to how he could know about complicity of the petitioners.

Regard being had to the facts and circumstances of the case, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hazaribag, in connection with Sadar P.S. Case No.892 of 2013 , corresponding to G.R. No.4057 of 2013 .
