05/08.03.2019 Petitioner is apprehending her arrest in connection with Godda (M) P.S. Case No. 70 of 2018 corresponding to G.R. No. 761 of 2018 for the offence registered under sections 341/ 323/ 313/ 498 A/34 of the Indian Penal Code and under section ¾ of the Dowry Prohibition Act.
Learned counsel for the petitioner has submitted that petitioner is maternal aunt of the husband of the informant and they have settled the dispute outside the Court. Learned counsel for the petitioner has further submitted that there was a case and counter case between the parties, as husband of the petitioner namely Mahesh Mandal has also filed a case against the informant and Nilesh Kumar but as the parties have already settled the dispute, as such, petitioner be enlarged on bail.
Learned counsel for the State assisted by learned counsel for the informant has not disputed this fact.
Considering the same, the petitioner named above is directed to be enlarged on bail in the event of her surrender/arrest within four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Godda in connection with Godda (M) P.S. Case No. 70 of 2018 corresponding to G.R. No. 761 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
