Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Kandra P.S. Case No.56 of 2018 registered under sections 467/468/471/420/414/34 of the Indian Penal Code and under Section 30 of Coal Mines (Nationalization) Act, 1973.

Heard the learned counsel for the petitioner and learned Addl. P.P. for the State.

The Learned counsel for the petitioner submits that the allegation against the petitioner is that petitioner is the Plant Head of Nilachal Iron Power co. Ltd. and eight trucks loaded with stolen coal were waiting to dump the coal in the said company without valid papers; on the basis of forged documents. It is further submitted that the allegation against the petitioner are all false and the petitioner was not present at the place of occurrence. It is also submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.16 of the anticipatory bail application. It is then submitted that the petitioner is ready and willing to furnish sufficient security including cash security and undertakes to cooperate with the investigation of the case. It is lastly submitted that the co-accused persons whose case stands on the similar footing have already been given the privilege of anticipatory bail by this Court vide orders dated 18.11.2019, 29.01.2019, 05.02.2019, 08.03.2019, 10.04.2019 and 09.05.2019 in A.B.A. Nos.4985, 167, 427, 1218, 2082 and 2750 of 2019 respectively.

Hence, it is submitted that the petitioner be given the privilege of anticipatory bail.

Learned Addl. P.P. opposes the prayer for grant of anticipatory bail.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing cash security of Rs.5000/- and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Seraikella, in connection with Kandra P.S. Case No.56 of 2018 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case subject to the conditions laid down under section 438 (2) Cr. P.C.
