Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner along with co-accused persons being armed with weapons came to the shop of the informant abused her, looted articles of the shop and took away Rs.3,000/- from her shop and on hue and cry being raised by the informant, they gagged her mouth, outraged her modesty and fled away from the place of occurrence. It is submitted that the allegations against the petitioner are false. It is then submitted that the father of the petitioner and father of the informant are own brothers and there is land dispute between the parties. It is next submitted that there is a series of litigation between the parties and the informant is in the habit of lodging false cases against the petitioner and in Narayanpur P.S. Case No.33 of 2019, police after due investigation did not send up the accused persons for trial and submitted final report. Drawing attention of this Court towards para-12 of the instant anticipatory bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is lastly submitted that the petitioner is ready and willing to co-operate with the investigation of the case and to pay ad interim victim compensation of Rs.15,000/- without prejudice to his defence in this case in favour of the informant of this case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
